Abstract
Corporate statements play a key role in reconstructing communications among competitors in the absence of contemporaneous records. The existence of a specific EU regulatory framework, and participation in only one aspect of a broader infringement, combined with unawareness of the overall scope of the infringement, are mitigating circumstances that can justify a significant reduction of cartel fines.
