Abstract

Under which conditions a community supports people in need is a key question of equality. Sharing among equals is usually easy. In most countries citizens are taken care of when in need. Foreigners, in contrast, are not automatically entitled to benefits. With EU citizens, solidarity becomes controversial. This article deals with the dynamic development of the European Court of Justice case-law and contrasts it with a constitutional counter-image.
