Abstract

Abstract This article is a brief presentation of the main principles ruling marriage and the rights and duties of spouses in France. As more and more couples have different nationalities or decide to live abroad, the focus is also on prenuptial agreements in a cross-border situation and the enforceability of such contracts in international law from a French law perspective. This article aims at providing some responses to the common questions raised by marital agreements, such as the conditions, scope and effects of marital agreements, their enforceability and the rights of spouses in case of divorce.
