Abstract

Fox Creek Mitigation Bank, located near St. Louis, Missouri, is the first stream mitigation bank approved by the U.S. Army Corps of Engineers (CE) in the country. Mitigation is a form of compensation for impacts to water bodies regulated by the CE u nder the Clean Water Act. Mitigation banking involves the creation or enhancement of an area specifically for use as mitigation, prior to impacts. The Fox Creek Mitigation Bank allows for in-kind stream mitigation rather than fragmented and out-of-kind compensation. The objective of the stream mitigation is to restore, enhance and protect a biologically significant urban stream while providing developers an alternative to costly delays from finding adequate mitigation. Approximately 4,200 meters of Fox Creek and adjacent riparian corridor is deed restricted and may be donated to the state or local municipality after the stream bank has been successfully established.
