Abstract

In a ground-breaking judgment, the Royal Court has given directions to the qualified member of a Jersey foundation, this being the first occasion that the Court had been asked to invoke a supervisory jurisdiction in respect of a Jersey foundation. The Court has analysed the extent of that jurisdiction and has confirmed that its jurisdiction was a live and potentially readily exercisable jurisdiction, when appropriately invoked. The Court accepted, on the facts of this case, that its jurisdiction had been properly invoked and that the qualified member was entitled to seek the assistance and the protection of the Court.
