Abstract

Assessments of criminal responsibility are required to ensure that mentally disordered accused are not unfairly punished for acts that they commit without the requisite intent. This chapter provides a brief overview of the history of and principles involved in the insanity defense in the UK and related legal systems. It touches on the subsequent management of those found not to be criminally responsible. It also reviews related defenses such as diminished criminal responsibility and automatism.
