Abstract

This article seeks to analyze the contours of the fine penalty and its implication in the execution of sentence and resocialization of economically vulnerable. To do so, it starts from the decision of the Superior Court of Justice in the revision of the understanding signed in the Repetitive Theme 931. Thus, it seeks theoretical grounds for extinction of the punishability in cases of default of those who do not have financial resources, since the penalty of a fine can show itself as a punishment of poverty.
