Abstract
This chapter focuses on marital disputes in order to analyze the involvement of women as litigants and their capacity for negotiation. It considers the legal options women had to negotiate marital disputes in a municipal court. The chapter focuses on another urban centers within the Bohemian crown, Brno. The Czech lands experienced dynamic development during the fourteenth and fifteenth centuries. The city of Brno has been chosen as a case study for various reasons. In the Middle Ages, it was a medium-sized royal city with a population of between 5,000 and 8,000. In characterising the personal-legal relations of spouses in these urban sources, the guardianship of a husband was of primary importance. Guardianship took various forms in different legal systems and geographical areas. Physical violence was one of the reasons why married women brought spousal disputes to the church courts.
