Abstract

The article deals with certain issues of using genetic information as evidence in a trial. The authors investigated the stages of the trial in the United States and Germany, at which the specified type of evidence can affect the final court decision, identified some features and contradictions in the use of genetic evidence at specific stages. The judicial practice in criminal cases of the considered category is analyzed. The influence of this kind of evidence on the general course of the case is studied. The use of such evidence is critically assessed.
