Abstract
تناول البحث موضوع" ضوابط الفتوى بين المسيار والتّعدد" دراسة تحليلية نقدية، وذلك من خلال تتبع آراء الفقهاء المعاصرين المجيزين والمانعين له وأدلتهم ومناقشتها ثم الرد عليها. ثم بيان الضوابط الشرعية التي تجعل من المسيار تعدد شرعي، مع كشف مكانته في مقاصد الشريعة الإسلامية، من خلال نتائج الدراسة الميدانية التي أجريناها مع خمسة نساء في الجزائر. وخلص البحث إلى صحة قول الفقهاء المعاصرين المجيزين بالكراهة للمسيار، لعدم تحقيقه للمصلحة العامة، وغلبة المصلحة الخاصة، ومن ثم بيان الحكمة من وراء كراهته وتحريمه عند بعض الفقهاء المعاصرين، لمخالفته لمقاصد كبيرة في الشريعة الإسلامية في الزواج؛ وبالتالي فالمسيار لا يمكن له، إلاّ أن يكون نموذجا حضاريا للتعدد المنصوص عليه في الكتاب والسنة.
