Abstract

This study raises the issue of what are the supporting and inhibiting factors of a notary in implementing Article 37 of the Notary Position Law No. 2 of 2014 (Undang-Undang Jabatan Notaris, UUJN), especially on the provision of legal services that are free of charge. This is an empirical juridical or sociological juridical research, which examines the applicable legal provisions and what actually occurs in the society. The approach used is sociolegal, which is an interdisciplinary approach in studying law that utilizes the science of sociology. This study concludes that first, the supporting factors are UUJN and the Notary Code of Ethics. Article 37 UUJN orders Notaries to provide legal services in the notary sector that are free of charge to people who are unable to afford it. Second, the inhibiting factor is the need for a notary to make a living for himself and the materialistic crush to meet the operational needs of the office. In addition, there is also a lack of legal counseling.
