Abstract

The application of big data and artificial intelligence technology in China’s judicial system has made tremendous progress in the past few years. In particular, emerging technologies represented by case retrieval have played a positive role in promoting judicial justice. However, the development and application of the case retrieval system is still in its infancy. There are many problems and the fairness issue of case retrieval is the most fundamental one among those. In this paper, we propose two main fairness issues in the Chinese judicial system that are faced with challenges in case retrieval: algorithmic-based fairness and attention-based fairness. We discuss the causes of both issues and give ideas for solving such issues.
