Abstract

On the striking cover of this important work, Attorney-General Sir Hartley Shawcross is captured addressing the International Court of Justice at some point during the Corfu Channel case. The date given for this photograph (on the back cover of the book) is 13 March 1948, although, from the official record of oral proceedings, we know that the Attorney-General presented before the Court on 28 February and 5 March of that year, on the preliminary objection of Albania. No matter, for this depiction still fulsomely conveys the intended message of how, even before the International Court of Justice, fact and law command their own theatrics and techniques of persuasion: ‘[t]he adversarial system’s equivalent of the invisible hand...
