Abstract

This chapter looks into extra-legal executions and its variety, summary or arbitrary execution. It examines the language used in the International Covenant on Civil and Political Rights in confirming respect for the right to life as a primary obligation. It discusses the European and American Conventions on Human Rights, the Arab Charter on Human Rights, and the African Charter on Human and Peoples' Rights in providing protection of the right to life. It also focuses on the approach of the UN Congress on the Prevention of Crime and Treatment of Offenders condemns murder or execution by governments. Furthermore, the chapter discusses two relevant UN instruments in prohibiting extra-legal executions: the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary, and Summary Executions and the Basic Principles on the Use of Force and Firearms by Law Enforcement Officials.
