Abstract

This paper starts by examining the nature of restorative justice. It then explores the use of restorative justice in the resolution of gender based violence cases and highlights the underlying strengths and weaknesses. The second part of the paper explores how restorative justice entrenches double victimization, inequality and suppression of the voices of the victims. It also highlight's how apology is used as a voice of manipulation by perpetrators and how feminine and masculine conceptions of offenders and victims influence the dispute resolution process. The paper concludes by emphasizing the need for a balanced approach that appreciates both the value of restorative as well as adversarial approaches in the resolution of gender based violence cases.
