Abstract

Abstract Expert evidence can often be of central importance in criminal proceedings. In recent years a great deal of attention has been focused on expert evidence as a result of a number of miscarriages of justice involving prosecutions following infant deaths. Until recently, it was left largely to the courts to develop the law concerning expert evidence issues, but the Criminal Justice Act 2003 (CJA 2003), the Criminal Procedure Rules 2005 (CPR), and guidance issued by both the CPS and the courts have meant that requirements about the management and use of expert evidence are now defined in considerable detail. This chapter will consider the overall picture concerning preparation, disclosure, and use of expert evidence before considering in more detail particular questions concerning legal professional privilege (LPP) and notification to the prosecution by the defence of names of experts.
