Abstract

Abstract The primary purpose of the statutory provisions is to prevent employees from receiving both a basic award and a redundancy payment. However, where an employee receives an enhanced redundancy payment, i.e., a payment over and above the statutory maximum, this may be set off against the compensatory award, but this applies only where redundancy is found to be the true reason for dismissal (Boorman v Allmakes Ltd[1995] IRLR 553). The relevant statutory provisions are examined in greater detail below.
