Abstract

This article is developed under the observance of related aspects regarding the evolution related to jurisprudence in the Brazilian context. The discussion on precedents and stabilization of the legal system by virtue of the interpretation of the law with the concrete case, and which results in the judicial decision paradigm, is not a novelty of contemporary law. Much is discussed in the Lusitanian law about this theme in Brazil and, therefore, it is necessary to understand the issue in order to understand the role of law today. Although the theme is broad, an overview of precedents will be brought with regard to their evolution. The method used for this study will be deductive, through a literature review in the literature pertinent to the subject. The conclusions of this research indicate that there is use of precedents in Brazil, however, much must be done, aiming, above all, at the effectiveness and standardization of these (Precedents) in the legal system.
