Abstract

The evolution of a new form of performance known as digital performance can be traced to the incorporation of technology in performances whether musical, dramatic or dramatico-musical performances. New communication technology made possible by mobile online platforms further enhance the emergence of digital performance. While the legal protection of sound recordings (SRs), musical and dramatic performance under the Nigerian Copyright Act has been extended to cover public performance rights, it did not expressly cover digital performance. This chapter aims to examine the legal protection of SRs and rights in performances under the Nigerian law, highlight legal protection of digital performance rights in other jurisdiction with the aim of identifying existing gaps in the Nigerian law and proffer recommendations that will enhance legal reform.
