Abstract
According to statistics, most the of old condominiums were built before the 1980s and more than 90% of them have been in high risk of collapse. Of that, nearly 25% in these areas are also in danger. There has been many "open" regulations in order to solve this problem such as Decree 101/2015/ND-CP (replacing Resolution No.34/2007/NQ-CP) on renovating and rebuilding the old condominiums. However, the consequence remains limited. The paper focuses on three major issues when renovating and rebuilding old apartments: (1) Policy framework for compensation, resettlement assistance; (2) Practical implementation of policy framework for compensation, resettlement support; (3) Some measures to improve the effectiveness of the implementation of policy framework for the compensation and resettlement.

Trong những năm gần đây, các chung cư, khu tập thể cũ trên địa bàn các thành phố lớn, mà chủ yếu tập trung ở Hà Nội, Thành phố Hồ Chí Minh đều xảy ra tình trạng quá tải. (i) Cơ quan nhà nước với vai trò kiến tạo hành lang pháp lý, cơ chế, duyệt quy hoạch khu vực chỉnh trang với quy mô hợp lý, thực hiện thu hồi đất, giải phóng mặt bằng, tái định cư, hỗ trợ tín dụng ưu đãi, điều phối chung, trong đó có vai trò rất lớn của hệ thống chính quyền cấp huyện và xã trong việc vận động, thuyết phục người dân đồng thuận. Tổ chức có trách nhiệm bồi thường chậm chi trả thì khi thanh toán tiền bồi thường, hỗ trợ cho người có đất thu hồi, ngoài tiền bồi thường, hỗ trợ theo phương án bồi thường, hỗ trợ, tái định cư được cấp có thẩm quyền phê duyệt thì người có đất thu hồi còn được thanh toán thêm một khoản tiền bằng mức tiền chậm nộp theo quy định của Luật Quản lý thuế tính trên số tiền chậm trả và thời gian chậm trả [11]
