Abstract

The aim of this paper is to highlight and to explore some elements of the so-called Rule of Law. More specifically, the intention is to discuss why, in Brazil, social and labor rights do not have the status of fundamental rights. In fact, this is why the adjective used in the title – Social Rule of Law – is not understandable, because it is a social and popular organization in which social and labor rights receive the status of fundamental rights.
