Abstract

The article highlights several issues related to the provision by the court of the right of defense of minors and criminally prosecuted persons with mental disorders. The authors analyze the reasons that imped law enforcement in such criminal cases. Several suggestions are formulated to improve the judicial practice of ensuring by the courts the right to defense in certain categories of cases, provided for by Chapters 50 and 51 of the Code of Criminal Procedure of the Russian Federation.
