Abstract
t The main objective of this paper is the theoretical and empirical recognition of the absorption of jus metaphysical values, principles and canons by the programmatic rules and its consequent binding and erga omnes normativity, especially in view of the neo-constitutional influence. Thus, the programmatic rules have full effectiveness with the Legislative, Executive and Judiciary Powers, its real substantiation being up to the latter. Thus, having normative force and maximum effectiveness, the constitutional program-rules compose the block of constitutionality, serving as a parameter to the control of constitutionality
