Abstract

This work deals with the concept of patrimony and its content regarding swindle. The author states a juridical and economical concept of patrimony, which includes all the economically valuable positions of a person, as long as they are not expressly di- sapproved by Law. Therefore, the concept of patrimony includes patrimonial rights, posses- sion and expectations, among other elements. On the contrary, obligations that are regarded as null and void because of being its content immoral or forbidden by Law are excluded from the concept of patrimony and no criminal liability for swindle shall arise thereof.
