Abstract

This paper revisits the hypothesis that if longer and more severe sanctions do not have a high level of dissuasiveness, the imposition of administrative sanctions will have a greater dissuasive effect on the conduct of previously sanctioned individuals and companies for (potential) environmental damage. The study to test this hypothesis has been done from a criminological perspective and using a new adaptation of an existing model of analysis of regulatory enforcement for sanctions imposed in Spain from 2013 to 2018.
