Abstract

The laws governing name and the right to have one Name is certainly at the center of every social structure. An element of individualization as well as identification, it is also a key element in the state of a person. French legislation as regards using, modifying or transmitting a name has a long, rich history. This history is marked by a slow but constant slide from the name as a police institution allowing individuals to be identified towards the name as a subjective right that can be claimed by individuals. However, a name remains one of the expressions of a filial link which allows the individual to situate himself in society as well as in his family circle. This name can thus be related to a biologi cal, social, psychological and affective reality. The object of this study is to understand, through precise examples, to what extent the legal evolution of name can have repercussions on these other aspects and make it into a new instrument of stigmatization.
