Abstract

This article looks at the evidence relating to the incidence of domestic violence. It discusses whether the victims are entitled to a duty of confidentiality in respect of the violence, considers their rights under Article 8 of the European Convention of Human Rights, and concludes that midwives would be lawfully justified in reporting reasonable belief that violence is occurring. It also considers the Home Office consultation paper on domestic violence.
