Abstract

This article examines the importance of innocence in criminal appeals through the lens of Benjamine Spencer’s murder case history and its development through the appeals process. Spencer’s case shows how innocent people can easily be convicted with false evidence and a flawed criminal justice system. Criminal appeals should provide a true path to resolve faulty convictions and fixed flawed aspects of the criminal justice process.
