Abstract

AbstractIn a recent action brought before the Dubai Court of Cassation, the Dubai Court of First Instance, the Court of Appeal as well as the Court of Cassation, it was held that the Diya Money (Blood Money) payable for causing death to other people by negligence will be Dhs 150,000 for male or female victims. The Court of Cassation held that the legislators in making reference to the deceased in Article 1 of the law, made no difference between the male or the female and therefore the generality of the law is meant to include both the male and female. Accordingly, the Dubai Court of Cassation upheld the judgment of the lower court awarding an amount of Dhs 150,000 to the deceased's heir and the appeal was dismissed.
