Abstract

This chapter sets out the key features of dispute boards and their development and relevance in the changing world of international contracting. It discusses: what dispute boards are, amicable dispute resolution, legal basis, various forms (dispute review board (DRB), dispute adjudication board (DAB), combined dispute board (CDB), dispute avoidance adjudication board (DAAB)), fundamental procedures and comparison of major forms (Fédération Internationale des Ingénieurs-Conseils (FIDIC), Chartered Institute of Arbitrators (CIArb), International Chamber of Commerce (ICC), Institute of Civil Engineers (ICE), American Arbitration Association (AAA), New Engineering Contract (NEC)), in-depth review of FIDIC’s DAAB in practice (from setting up a DAAB through to jurisdiction and enforcement issues in light of recent case law), Red, Yellow, Silver, Blue-Green, Emerald Books and subcontracts, use by multilateral development banks (MDBs) and adoption of FIDIC’s DAAB by the World Bank, personal experiences from the CERN LHC project, conclusions and future challenges including arising from COVID-19.
