Discussion on the legal clinic for the protection of the rights and interests of the disabled

Abstract

As a new mode of practice teaching, law can not only help Law School of theoretical knowledge into practical ability, but also to provide legal aid for vulnerable groups. This paper put forward a tentative idea on construction of the protection of rights and interests of legal which is a new legal clinic, in order to promote continuous improvement of China's legal education. The origin of a disability rights protection legal Legal is a new method of education originated in United states. This method of education is generated from medical education mode. In medical school students need to spend considerable time in clinical medicine, diagnosis and treatment will be from practice. When introducing teaching method of law education, law school cited clinic in title, it produced a unique name legal this law field. The disabled rights protection law, as name suggests, is a dedicated to protection of rights and interests of disabled as goal of new legal clinic. The difference between disabled rights protection law and other legal is protection of rights and interests of disabled as a center, more professional and normative. Legal to protect interests of persons with disabilities is mainly through form of legal aid to help disabled, with ties to community more closely, in view of this, legal to protect interests of persons with disabilities will be conversion of legal education is a out of law school fence outside service in form of community. The protection of rights and interests of legal has its practical basis. First of all, building a legal for protection of rights and interests of disabled is requirement of principle of equality of human rights. Constructing legal to protect interests of persons with disabilities, in full respect for disabled of equality of human rights under premise, through legal aid in form of effort to helping disabled people to solve legal problems, realize development in an all-round way, real guarantee for people with disability rights and right to development and other basic human rights. Therefore, we should actively build a legal for protection of rights and interests of persons with disabilities in order to make due contributions to equality of human rights in our country. Secondly, constructing legal for protection of rights and interests of disabled is embodiment of social fairness and justice. As a social vulnerable group, disabled people's ability to take care of themselves is poor, right to subsistence and development is highly vulnerable to abuse. Therefore, state, society and individuals should actively take measures to protect legitimate rights and interests of disabled. To establish and improve legal clinics of rights and interests of persons with disabilities can not only protect rights and interests of people with disabilities, but also guarantee enjoyment of rights and interests of people in life of people in social life.
