Abstract
Structural Reform Litigation has become a strong instrument in order to advance in the protection of social rights, however an increasing number of Constitutional Courts still face many challenges. Using a multidisciplinary and comparative methodology including the evaluation of several structural cases in countries such as South Africa, Colombia and India this paper explores the challenges facing Courts in order to ensure a greater impact on the fulfillment of social rights. The research found that some Courts are still very “shy” particularly in the design and implementation of Dialogic Remedies. Constitutional Courts should give priority to building strong mechanisms of monitoring at the moment of formulating these remedies.
