Abstract

As a public subjective right, the general right to public information is subject to limitations at both the constitutional and statutory levels. Significant in this respect are the provisions of Article 61(3) and Article 31(3) of the Constitution of the Republic of Poland of 2 April 1997 and Article 5 of the Act of 6 September 2001 on access to public information. Paragraph 2b of Article 5 of the Law on Access to Public Information indicates a specific type of restriction related to the regulations of the Law of February 12, 2010 on the Recapitalization of certain institutions and governmental financial stabilization instruments. The focus of the deliberations conducted has been centered on detailing the essence and nature of this limitation.
