Abstract

Abstract. The author provides an interesting analysis of the evolution and present situation of social rights and the welfare state, with an emphasis on the array of realities of the country members of the european union and the european union itself. The work highlights the historical trend to use programatic rules to regulate these rights, as well as the leading role of case law in its development, in spite of a sharp dose of instability. upon pinpointing the special case of health, the author refers to what he calls social coldness in the union (with respect to social rights) and the need to regulate these rights.
