Abstract
AbstrakThis article trying to remind on the basic function of land as the ultimatesource of living. On the author 's sight that principle deemed has beendishonored by law enforcers and government agency whom hold authorityon land affairs. It has been figured out from bleeding incident in Alas Tlogo.East Java that had been triggered by land dispute. In that incident hasproved syndrome of despotic's state power. Justice in land was violated bypositive law in where beraucracy and administrative that still on the lack ofgood services reflection. At the edge has resulted court sessions which alsocarry out the same spirit like another government agency as said by theauthor like circus-clowns. By that argument the author give her explanationconcerning democratic state 's idea. prosperity of people direction justhappens in imagination outlook.

Tragedi sengketa tanah membawa petaka di desa Alas Tlogo, Kabupaten Pasuruan tanggal 30 Mei 2007. Sengketa antara penduduk setempat dengan Korps Marinir Tentara Nasional Indonesia Angkatan Laut (TNI-AL) berawal pada sengketa di pengadilan lahan seluas lebih kurang 3500 hektar yang selama ini digarap rakyat. Marinir melakukan eksekusi lengkap dengan bulldozerl Rakyat yang merasa telah menggarap tanah tersebut selama puluhan tahun, mencoba bertahan dengan sekuat tenaga. Dilaporkan bahwa tindakan warga telah menjurus pada tindakan anarkis dan kemudian Marinir. I Padahal eksekusi hanya dapat dilakukan pada putusan pengadilan yang berkekuatan hukum tetap. Negara yang memiliki hak menguasai tanah ini tampaknya melupakan bahwa sumber kekuasaan yang ada padanya adalah titipan rakyat melalui du contract social. Apakah kebenaran formil dapat sena mena dilerapkan pada kasus-kasus pertanahan kita tanpa memperhatikan keadilan yang hakiki dan nilai dari demokrasi itu sendiri ?
