Abstract

This article is a review of Professor Jed Rubenfeld’s article Unilateralism and Constitutionalism. The author deals with Rubenfeld's contention that human rights law is deeply undemocratic to the extent that they are sought to be universally validated. Is this argument tenable and if so, is universality of human rights a legal fiction? In answering these issues the author discusses several philosophical foundations of human rights.
