Abstract

The main aim of this paper is to address the most important challenges associated with the BAT conclusions associated emissions-levels application. In the first place, there will be made a short presentation of the air emissions reduction framework. Secondly, the specific status of the BAT conclusions under the IED is presented. The third section discusses issues crucial to the BAT conclusions' application process, which are identified as follows: the wide discretion given to the competent authority, possibility of applying a derogation, and centralized and decentralized application control. The fourth section provides some final remarks and argues for a more balanced approach to the application of the BAT conclusions, which should attain not only environmental aims but should also reflect the aim to maintain the operation of industrial nstallations within the EU.
