Abstract

Art. 158 para. 1 lit. b var. 2 of the Swiss Civil Procedure Code allows a party to evaluate the chances of a potential litigation through pre-trial taking of evidence. This requires a legitimate interest. The article discusses the way in which case law and doctrine interpret this condition and advocates a less restrictive interpretation.
