Abstract

Abstract: This paper discusses a study which investigated the factors influencing the use of custody for a sample of offenders sentenced for theft offences. The results suggest that the decision to use custody was affected by a number of factors which fit with a just deserts approach to sentencing. However, other contributory factors were also identified and the implications of these results are discussed. It is argued that sentencers should be encouraged to persevere with community penalties even when they are breached, in the same way that they persevere with the use of custody even when it fails to deter offending.
