Abstract

The article highlights the legal nature of the system of sources of law, its internal construction. In particular, the study of the legal nature of the system of sources of law is offered to go with the basic principles of the system approach and methodology of system analysis. The system of sources of law is seen as a set of interrelated and mutually regulatory and legal requirements, that expressed in relevant external forms and form a legal organization necessary for regulation in any society. One analyzes such structural sections of the system of sources of law of Ukraine as branch (horizontal) and hierarchical (vertical). Subsystems of the system of sources of law in Ukraine are analyzed, namely system of normative acts (consisting laws and regulations regulations of Ukraine), normative contracts (collective agreements, international treaties of Ukraine), system of legal customs. One reveales the problem of the forming of the system of sources of law in Ukraine, defines the main directions of its development, including changing the content of classical brances and the emergence of new brances and institutes, forming of brances and institutes that are mixed and complex, indicates the high dynamics of development of the system of sources of law in Ukraine. It is noted that the normative act subsystem in Ukraine, as the dominant system of sources of law Ukraine, is overloaded with a large number of regulatory and legal requirements and specific forms of a legal acts. This impedes the proper regulation of social relations. Attention is focused on the need to correct choice of legal form sources of law, organizing and unifying the legal and regulatory requirements and optimal system of sources of law that creats an effective system of sources of law. It is noted that the integration pocesses in Ukraine are of crucial direction for a modern system of sources of law in Ukraine, since provide its quality, influenced by European legal standards.
