Abstract
The article presents a critical overview of the eight ‘residual functions’ of the International Criminal Tribunals for the former Yugoslavia and for Rwanda to be performed by the International Residual Mechanism for Criminal Tribunals, namely trial of fugitives; trial of contempt cases; protection of witnesses; review of judgments; referral of cases to national jurisdictions; enforcement of sentences; assistance to national authorities and management of the Tribunals’ archives. It also deals with the Transitional Arrangements, which determine which organ of either the Mechanism or the appropriate Tribunal will be competent to complete ongoing proceedings or to commence new proceedings.
