Abstract

The definition of State stated by Hans Kelsen (1958) says that its principal objective should be to guaranty the welfare of its citizens, achieving, in a considerable period of time, an evolution through the implementation of legislatures that yield positive results. Thus, the mechanism used by the State in order to satisfy de demands of the population is the creation of laws and public politics as a product of the dynamics in the political system. This article pretends to make a theoretical and ethical approach to the democratic state crisis, from the analysis of two fundamental aspects: the inability of the political system to create adequate and coherent public policies and laws, and the lack of political will of governments to meet the needs and demands of the population. Finally, and due to the necessity of contextualizing this reflection to particular conditions that show the issues mentioned above, we dedicate several lines along this paper to the specific case of the Colombian State, which political system, notoriously outraged, has implemented policies against the needs of an apparently voiceless society
