Abstract

In the article, based on the results of the study of socio-demographic, socio-psychological, moral- psychological and criminal-legal features of the subjects of the crimes provided for in Art. 366-2 and 366-3 of the Criminal Code of Ukraine, a criminological portrait of a person who committed the crimes provided for in Art. 366-2 and 366-3 of the Criminal Code of Ukraine. It was established that most of them are men (56.4%) aged between 30 and 65 (84.6%), citizens of Ukraine (100%), who have a higher education (35.9%) or professional-technical (32%) education, non-convicts (98.7%) both married and single. They hold the positions of state and other civil servants at the lower and middle levels. All persons who commit the outlined socially dangerous acts are mentally healthy and mentally stable at the time of their commission, and therefore they are not on psychiatric or narcological records. At the same time, it can be assumed that some of the corrupt officials who commit these crimes develop an addiction to bribery.
 A significant part of the characteristics of the subjects of the specified torts is determined by their position as a person authorized to perform the functions of the state or local self-government, to which normative requirements regarding citizenship, education and work experience are usually put forward.
 Subjects of crimes provided for in Art. 366-2 and 366-3 of the Criminal Code of Ukraine, commit the specified torts individually, however, despite this, other persons (family members and assistants) may be involved in the specified acts. The motives and purpose of criminally illegal activities are different and not always related to illegal enrichment.
 Among the subjects of crimes provided for in Art. 366-2 and 366-3 of the Criminal Code of Ukraine, it is possible to single out both corrupt officials who seek to hide the results of their illegal enrichment, and other criminal offenders who hold or have held positions of persons authorized to perform the functions of the state or local self-government.
