Abstract

In the Russian Federation, the retail lending market is a rapidly growing and developing segment of the financial market, and despite the current economic situation in the country, there is a significant increase in the volume of consumer loans issued. The level of debt burden of the population is also rapidly increasing. Banks and other credit organizations are forced to contact collection agencies to return overdue debts. The actions of employees of collection agencies often go beyond the legal framework, generating new types of crimes with their illegal actions. This article is devoted to the study of the peculiarities of the forensic characteristics of crimes committed by employees of collection agencies against debtors and their relatives. For a comprehensive study of this phenomenon, an analysis of various points of view regarding the legal nature, essence and structure of the forensic characteristic of the crime is carried out. As a result of the study, elements of the forensic characteristics of crimes committed by employees of collection agencies against debtors and their relatives, the most significant crimes for this category, were identified and examined in detail. The authors attributed to them tools and means, traces of a crime, the place and time of the crime. The article also traces possible correlation links between these structural elements of the forensic characteristic. The method of committing a crime by employees of collection agencies against debtors and their relatives allows the applicant to identify and trace his relationship with such elements of the crime mechanism as tools and means of committing it, traces (both material and ideal), which displayed the method and tools used, the influence of the place and time of committing a crime on their choice. In conclusion, the author, summarizing the information studied, draws conclusions about the effectiveness of using the forensic characteristics of crimes committed by employees of collection agencies in relation to debtors and their relatives in practice to create private forensic methods.
