Abstract

AbstractPurpose: This work explores issues related to the concept of a crime qualification algorithm and the possibility of its automation in the context of the use of digital technologies. Design/methodology/approach: The circumstances of theoretical, normative, and law enforcement properties have been analyzed, which complicate the possibility of automating the crime qualification process. Findings: The authors paid special attention to the scientific justification and confirmation of the practical feasibility of automating the process of characterizing crimes. Agreeing with the inevitability and obvious advantages of automation of the field of criminal law enforcement, the work emphasizes the requirements for automated algorithms of this activity and draws attention to a wide discussion on the introduction of elements of “artificial intelligence” in law enforcement practice. Originality/value: It has been established that the concept of “algorithm,” being a phenomenon of interdisciplinary property, is logical to interpret in a broad sense. Hence, the algorithm for characterizing crimes is proposed by the authors to be understood as a set of rules and recommendations covering all laws related to the criminal legal assessment of the act. The authors revealed the conservatism and tradition of criminal law.
