COVID-19 and the Freedom of Religious Assembly

Abstract

코로나19의 전세계적 유행이 시작된 지 1년이 넘었다. 감염자와 사망자의 수가 적지 않다. 정부는 마스크 착용과 사람의 집합금지 등을 주요 내용으로 하는 기본권의 제한과 함께 백신 접종을 진행하고 있다. 종교적 집회도 예외가 아니다. 이러한 조치의 결과는 성공적인 것으로 평가되고 K-방역이라고도 불린다. 그러나 이러한 결과는 미지의 역병에 대한 강력한 대처에 암묵적으로 동의하고 이의제기나 항의의 기회도 없이 기본권에 대한 강한 제한이 이뤄진 결과라고도 할 수 있다. 좀 더 덜 제한적인 수단에 대한 진지하고 신중한 고려보다는 긴급한 상황에서 일률적인 제한이 이뤄졌다. 천재･지변이나 내우･외환에 대한 대처는 전사회적 협력을 필요로 한다. 그리고 그것은 한편으로는 이에 협력하지 않는 자에 대한 비난과 배제를 수반한다. 모든 사람은 나에게 코로나19를 감염시킬 수 있는 위험원으로 인식된다. 그래서 나와 다른 행동은 용납되지 않는다. 감염병과의 전쟁은 자칫 비상시국을 틈타 전체주의 또는 전체주의적 사고의 등장을 예고한다. 방역을 위한 조치에 문제점이나 모순이 적지 않다. 야간 활동을 금지하는 것도 정당한 것인지 의문이다. 만원 지하철의 이용과 집회의 금지가 공존할 수 있는 것도 모순이다. 어떤 이들에게는 지금이야말로 항의가 필요한데 항의의 방법이 집회나 시위밖에 없는데도 집회가 쉽지 않다. 종교적 집회인 예배에 대한 제한에 관하여 헌법소원심판이 청구되었다. 합리성과 가장 거리가 있는 종교인들이 코로나19에 대한 문제제기를 하고 있는 역설적 상황이라고도 할 수 있다. 헌법재판소가 행정명령을 헌법에 위반된다고까지 결정하지는 않을 것이라고 해도 모든 제한이 헌법적으로 정당화된다고 하기도 어렵다는 점에서 헌법소원에 담긴 헌법위반이라는 문제의식과 도전은 중요하다.It has been more than a year since the pandemic of COVID-19 began. The number of infected and dead is not small. The government is carrying out vaccinations with restrictions on basic rights, such as wearing masks and prohibiting people from gathering. Religious assemblies are no exception. The outcome of these measures is evaluated as successful and is also referred to as K-quarantine. However, this result can be said to be the result of strong restrictions on basic rights, without implicit consent to a strong response to the unknown plague, and no opportunity to appeal or protest. Rather than serious and careful consideration of less restrictive alternatives, uniform restrictions were made in urgent situations. Constitutional complaints have been filed against restrictions on worship as a religious assembly. It can be said that it is a paradoxical situation in which religious people who are the most distant from rationality are raising concerns about COVID-19. Even if the Constitutional Court will not decide that the executive order is unconstitutional, the awareness and challenge of the constitutional violation contained in it is important.
