Abstract

Twelve years after Congress vested the Federal Energy Regulatory Commission (FERC) with authority to assess civil penalties for manipulation of energy markets through the Energy Policy Act of 2005 (EPAct 2005), federal courts finally have begun shedding light on the scope of FERC's prohibition of market manipulation authority and the legality of its enforcement processes.
