Abstract

The article examines the main features of a jury trial as a procedural form of criminal proceedings, gives the characteristics of a jury trial as a complicated procedural form in the system of forms of criminal proceedings and highlights certain problems of its functioning. The aim of the study is a theoretically and practically grounded determination of the place of the institution of jurors as a form of consideration of criminal cases in court among other forms of criminal proceedings. The achievement of this goal is due to the solution of such tasks as – identifying the features and characteristics of the studied form of criminal proceedings, analyzing statistical data on the revisions of court decisions, highlighting the advantages and problems of considering criminal cases in a complicated form. The methodological basis for writing the article was the dialectical method of scientific knowledge, as well as general scientific methods – research, systemic and structural-functional methods of cognition, comparative legal and statistical. As a result of the study, we can state the extreme importance and need to improve the institution of the jury as one of the forms of consideration of criminal cases in court. The special place of the investigated institution in the system of forms of criminal proceedings makes it possible to provide participants in criminal proceedings with increased measures of social protection, being a complicated procedural form of judicial proceedings, the institution of jurors as such provides for additional procedural guarantees when considering criminal cases of crimes of increased public danger. The necessity of strengthening the authority of the judiciary, as well as the formation of skills for the participants in the process of their procedural functions, taking into account the specifics of the investigated form of criminal proceedings, has been substantiated.
