Abstract

The purpose of this paper is not to advocate against Court-annexed mediation nor ignore their positive results. Both the American, and more recently British, experience demonstrate how successful such scheme is. A study on court-annexed mediation in Florida, an American state that is recognized as a leader in the development of such scheme, showed that the institutionalization has many downsides, such as the assimilation of authority and formality of the court to the mediation program . The paper highlights the importance of preserving the core values of mediation and discuss the political decisions that must be taken when establishing court-annexed mediation structure.
