Countermeasure to the Abuse of the Kill-Switch Function on Mobile Phone

Abstract

일부 범죄피의자들이 자신의 휴대폰이 압수된 이후에 킬스위치 기능을 이용하여 원격으로 휴대폰의 증거를 삭제하는 증거인멸 수단으로 악용하고 있다. 킬스위치 기능은 휴대폰의 분실과 도난 등으로부터 사용자의 개인정보 보호 및 재산권 보호차원에서 서비스 되는 기능이다. 이에 대한 실제 사례들을 통해서 킬스위치 기능의 작동 메커니즘을 살펴보고 이의 예방을 위해서는 압수현장에서부터 수사관들이 데이터통신 차단 등 필수조치를 취함으로써 예방을 할 수 있음을 알아보았다. 나아가 통신사 측에서는 수사기관에서 통보한 범죄피의자의 분실신고 신청에 대해서 개별 약정위반으로 거절할 수 있는 근거도 확인하였다. 중요한 것은 주무부처인 과학기술정보통신부에서 가이드라인을 만들어 통신사에 협조를 구하고 통신사에서는 이를 근거로 약관을 변경하여 수사기관의 요청이 있을 시 압수된 피의자의 휴대폰에 대해서는 분실신고 접수를 거절할 수 있도록 명문화 시킨다면 앞서 살펴본 사례와 같은 증거인멸 행위를 방지할 수 있을 뿐 아니라, 공공의 이익에도 부합한다고 판단된다.Some criminal suspects are abusing evidence as a means of erasing evidence of mobile phones remotely using the kill switch function after their cell phones are confiscated. The Kill Switch is a function that is provided to protect users personal information and property rights from the loss or theft of mobile phones. We have looked at the mechanism of wiping evidence remotely and we have seen that from the confiscation site, investigators can take preventive measures, by taking necessary measures such as blocking data communication. Furthermore, we confirmed that the service provider may refuse an application for a lost cell phone service from a criminal notified by an investigation agency due to violation of individual terms. Importantly, the Ministry of Science and ICT create a guideline and requests cooperation from the telecommunication companies, and the telecommunication companies change the terms on the basis of the guideline and if the request is made by the investigation agency, it is possible to prevent the evidences like the one we have seen above, and it can also be seen that this corresponds to the interests of the public.
